What is the Washington rental car tax in 2026?

11.9 percent of selling price on each retail car rental, up from 5.9 percent on 1 January 2026. It drops to 9.9 percent on 1 January 2027.

This is the single largest rate change in any state this year

The rate doubled. Any pricing, any quote tool and any tax table still carrying 5.9 percent is undercollecting by half, and the liability for the difference sits with the operator rather than the renter.

The Department's own older material still shows the old rate

A legacy Department of Revenue reference PDF still states 5.9 percent. It is a 2022 document and it is obsolete. The same PDF lists a King County 2 percent stadium rental car tax which does not appear on the current rate schedule and should be treated as expired. Work from the current rate page and the 2026 addendum, not from an archived summary.

What counts as a rental car

A passenger car rented for less than 30 days, designed to carry 10 passengers or fewer. Motorised recreational vehicles and motor homes qualify. The duration is fixed at the time of rental, so a daily rental that a customer keeps past 30 days remains taxed as a daily rental rather than converting.

What is outside it

Loaner cars from automotive repair businesses, licensed taxicabs, vehicles leased for 30 days or more, vehicles designed or used to transport property or animals, and shared vehicles used in peer-to-peer car sharing are all outside the rental car tax. The federal government is not required to pay it, though government employees must unless the rental is paid by government voucher or an approved government card. Vehicles rented under an original manufacturer's warranty remain subject to the rental car tax even though retail sales tax does not apply, so the warranty exemption certificate cannot be used to avoid it.

What do you pay on top of the rental car tax?

A county addition of 1 percent in five counties, a regional transit addition of 0.8 percent inside the RTA district, and separately the full retail sales tax.

Sales tax stacks on top of all of it

The state sales tax is 6.5 percent and local rates take the combined figure to roughly 7.7 to 10.7 percent depending on jurisdiction. A Seattle rental therefore carries both the 13.7 percent rental car tax and a sales tax in the region of 10 percent. Washington is the most heavily taxed rental market in this batch by a wide margin.

One tax it does not carry

Rental cars are exempt from state and local motor vehicle excise tax. The additional rental car tax was imposed in its place when the structure was created, so this is a substitution rather than an extra layer.

What licenses do you need to rent cars in Washington?

A Washington business licence carrying the Rental Car state endorsement. The endorsement itself is free, and you may not begin retail rental car activity until the licence shows it.

The endorsement is a gate, not a formality

A business may not start renting until it holds a business licence showing the Rental Car endorsement. The endorsement fee is zero and state tax registration is zero, so the barrier is time rather than cost. Apply before you plan to open, not after.

Your registration number goes on every vehicle registration

Washington issues a rental vehicle business registration number, and that number must be included on each vehicle's registration. The legal and registered owner name on the registration must be identical to the business name shown on your master licence, which catches operators who register vehicles under a slightly different trading name.

Selling insurance at the counter needs its own licence

A rental car company, or its officers, directors, employees or agents, may not offer, sell or solicit rental car insurance unless licensed as an insurance producer or as a rental car insurance producer by the Insurance Commissioner. Washington and Ohio both require this. Pennsylvania does not.

Where your vehicles must be registered

Rental vehicles must be registered in Washington unless the customer rents at a location outside the state, a prior renter drops the vehicle at a Washington rental business on a one-way trip out of state, or the vehicle is part of a properly registered interstate fleet. Rental vehicles may be driven only by rental customers, except when you move a vehicle between your own sites, take it to or from maintenance or repair, or test it. A photocopy of the current registration certificate may be kept in the vehicle rather than the original.

How do you file and pay Washington rental car tax?

On the Rental Car Tax Addendum, filed with your Combined Excise Tax Return. Make sure you are using the addendum for 1 January 2026 onward, not the earlier one.

There are two addenda and only one is current

The Department publishes separate addenda for the period to 31 December 2025 and for 1 January 2026 onward. Filing on the old one will carry the old rates.

The tax does not have to appear on the invoice, but it must be in your records

Washington does not require the rental car tax to be shown separately to the customer. It does require you to track it separately in your records. Many operators show it anyway for transparency, which is sensible, but the compliance obligation is the recordkeeping.

What insurance is required for rental vehicles in Washington?

25/50/10 for ordinary rental operations. Peer-to-peer sharing requires twice that.

The disclosure rules bite harder than the limits

Washington's substantive rental regulation is about selling insurance rather than about limits. Where you offer rental car insurance you must, at every location where agreements are signed, give each purchasing renter written materials summarising material terms, exclusions, limitations and the insurer's identity, the claims process with a toll-free number, your name, address, phone and licence number, and the Commissioner's consumer hotline. The materials must state that coverage may duplicate the renter's own policies, that purchase is not required to rent, and that you are not qualified to evaluate their existing coverage. The renter acknowledges receipt in writing, evidence of coverage appears on the face of the agreement, and all insurance costs are separately itemised.

What you may not do

You may not sell insurance except in conjunction with and incidental to rental agreements, portray yourself or your staff as a licensed insurer or producer, or pay anyone, including counter staff, compensation that depends primarily on placing insurance. That last prohibition is the one most likely to conflict with an existing commission scheme.

Damage waivers sit outside all of it

Washington defines rental car insurance as four products: personal accident, liability including uninsured motorist, personal effects, and roadside assistance or emergency sickness protection. A collision damage waiver is not among them, so the disclosure regime above does not reach waivers at all.

What do peer-to-peer hosts pay in Washington?

In 2026, no rental car tax. A shared vehicle used in peer-to-peer car sharing is not a rental car for this purpose, so the 11.9 percent does not apply. Retail sales tax still does.

The insurance requirement is double the ordinary minimum

During each car sharing period the owner and driver must carry liability of at least twice the state minimum, so 50/100/20 rather than 25/50/10. Coverage may come from the owner, the driver, the program or a combination, and it is primary during the period. If the policy lapses or is inadequate, the program's policy covers from the first dollar with a duty to defend. The program also assumes primary liability in certain disputes over who had control, if it cannot produce the required use records.

Records for as long as someone could sue

Washington requires use records to be retained at least as long as the applicable personal injury statute of limitations, rather than a fixed number of years. That is a longer and less certain obligation than Michigan's flat three years or Ohio's three.

Do not cite the old chapter

Washington's previous personal vehicle sharing chapter was repealed in 2022 and replaced. Any guidance still pointing at it is describing law that no longer exists.

What changes on 1 January 2027?

Two things. The rental car tax drops to 9.9 percent, and peer-to-peer car sharing becomes taxable for the first time, but only for some hosts.

The new peer-to-peer tax depends on how the host bought the car

From 1 January 2027 an additional tax at the retail car rental rate of 9.9 percent applies to peer-to-peer car sharing, but only where the vehicle owner obtained the vehicle for resale using a reseller permit or an approved exemption certificate. A host who paid sales tax when they bought the car is not caught. A host who bought it tax-free on a reseller permit is. That is an unusual test and it will surprise people.

Platforms take on a certification duty

Also from 1 January 2027, a program may not list a vehicle unless it receives electronic certification from the owner about how the owner acquired it, and it must retain that record for at least five years. A program that relies in good faith on the owner's certification is not liable for taxes or penalties imposed on the owner. If you run a platform, this needs building into host onboarding well before the date.

What to do now

Two system changes are already dated. Tax tables need reconfiguring for 9.9 percent effective 1 January 2027, and host onboarding needs the acquisition certification step. Neither is urgent today and both are certain, which makes them worth scheduling rather than discovering.

Frequently asked questions

  • 11.9 percent of selling price, doubled from 5.9 percent on 1 January 2026. It drops to 9.9 percent on 1 January 2027. With county and regional transit additions the combined rate reaches 13.7 percent in King and Pierce counties.

  • A legacy 2022 reference PDF still carries the old rate, and it also lists a King County 2 percent stadium tax that is no longer on the current schedule. Use the current rate page and the 2026 addendum instead.

  • Yes. State sales tax is 6.5 percent with local rates taking the combined figure to roughly 7.7 to 10.7 percent, and that stacks on the rental car tax. Rental cars are, however, exempt from motor vehicle excise tax.

  • Yes. A Washington business licence with the Rental Car endorsement. The endorsement is free, but you may not begin renting until the licence shows it. Selling rental car insurance requires a separate producer licence.

  • Not in 2026. A shared vehicle used in peer-to-peer car sharing is not a rental car for this tax. From 1 January 2027 a 9.9 percent tax applies, but only where the owner acquired the vehicle using a reseller permit or exemption certificate.

  • At least twice the state minimum during each sharing period, so 50/100/20 rather than 25/50/10. Coverage is primary during the period, and the program covers from the first dollar with a duty to defend if the personal policy lapses.

  • On the Rental Car Tax Addendum with your Combined Excise Tax Return, annually if liability is $1,050 or less, quarterly to $4,800, monthly above that. Use the addendum for 1 January 2026 onward, not the earlier version.

  • No. Washington defines rental car insurance as personal accident, liability, personal effects and roadside assistance products. A damage waiver is not among them, so the disclosure rules do not apply to waivers.
