Compliance & Tax · Virginia
Virginia car rental operators must hold a Certificate of Registration as a rentor from the Department of Taxation before they can title a single vehicle as rental stock, collect a 10 percent motor vehicle rental tax made up of three separate components, file monthly on Form MVR-420, and carry liability coverage of at least 50/100/25. General sales tax does not stack on top. The 10 percent is the whole transaction tax.

A Certificate of Registration as a rentor, issued by the Virginia Department of Taxation. You cannot title a vehicle as rental stock without it, so this is the first step rather than a later formality.
Virginia will not let you title or register a vehicle as rental stock until you hold the certificate and can supply your rental number on the application. Operators who buy the fleet first and handle paperwork second end up with vehicles they cannot legally rent.
The certificate is issued per location and is not transferable. It must be displayed at each place of business, and if you collect the tax through a website or app, it must be displayed there too. Open a second lot and you apply again.
The rental tax was administered by the DMV until 1 July 2012, when it moved to the Department of Taxation. Guidance written before that date sends operators to the wrong agency. Go to Taxation.
As three separate components that add to 10 percent on most passenger vehicles: a 4 percent Rental Tax, a 4 percent Local Tax, and a 2 percent Rental Fee. They are listed separately in the statute but charged as one rate to the renter.
| Component | Rate | Applies to |
|---|---|---|
| Rental Tax | 4% | Vehicles rated 26,000 lb GVWR or GCWR and under |
| Local Tax | 4% | All vehicles except motorcycles and manufactured homes |
| Rental Fee | 2% | All vehicles except motorcycles and manufactured homes |
| Total | 10% | Most passenger rentals |
The current three-part structure took effect on 1 October 2020 under SB 735. Anything describing a different Virginia rental tax split is pre-2020 and no longer correct.
Virginia's general retail sales tax, 5.3 percent at base and up to 7 percent in the Historic Triangle, does not apply on top of the rental tax. The 10 percent is the entire state and local transaction tax on the rental. That makes Virginia simpler than states where a rental surcharge sits on top of sales tax, and it is worth stating plainly on your rate display so renters do not expect a second line.
Several charges you may bill are excluded from the amount the 10 percent applies to:
- Fines and citations passed through to the renter
- Delivery, pickup, recovery and drop-off charges
- Pass-through charges and transportation charges
- Third-party service charges
- Refueling surcharges
- Motor Vehicle Sales and Use Tax
The rental tax applies to rentals of less than 12 months. At 12 months or more the transaction is treated under lease and sale rules instead, which is a different tax outcome entirely. Virginia's threshold is unusually long. Most states draw the line at 28, 30 or 31 days.
Exemptions under section 58.1-1737 cover US and Virginia government bodies and political subdivisions, re-rental, taxicab arrangements where the vehicle is rented to the driver, driver training schools and private schools providing driver education, and mobile CT and diagnostic units rented to qualifying nonprofit hospitals. Trucks and tractor trucks rated 26,001 lb and above are exempt from the 4 percent Rental Tax component only, not from the other two.
7 percent of gross proceeds, instead of the 10 percent rental tax, if you register 10 or fewer shared vehicles. Register more than 10 and you pay the full 10 percent.
The 10-vehicle test counts vehicles listed across all platforms combined at one time, and it applies whether or not all of them actually rent. List 11 across two platforms and the 7 percent rate is gone even if only four were booked. Owners must certify their vehicle count to the platform before listing and keep it current.
A platform with economic nexus in Virginia collects and remits. Nexus means more than $100,000 in gross revenue or at least 200 sharing transactions in the previous or current calendar year. Where the platform does not collect, the obligation falls on the owner. That is the trap for a host using a smaller platform.
Sections 46.2-1408 to 46.2-1418 require the platform to ensure both owner and driver are insured during every sharing period, and the platform assumes primary liability for third-party injury and property damage claims. Where coverage has lapsed, the platform carries first-dollar coverage and the duty to defend. Records of driver identity, usage times, locations, fees and owner revenue must be kept for at least five years.
Monthly, on Form MVR-420, due the 20th of the month following the period, filed electronically with the Department of Taxation.
The return is delinquent on the 21st. There is no quarterly or annual option based on volume, which several neighbouring states offer. Every operator files monthly.
If you took no rentals in a month, you do not file. That is a genuine difference from states that require a zero return, and it matters for seasonal operators.
Rental tax locality codes differ from sales and use tax locality codes. An operator who also files sales tax on other activity cannot reuse the same codes, and mismatched codes are a common source of correction notices.
50/100/25 for policies effective on or after 1 January 2025. Renting a vehicle without a driver when it is not an insured motor vehicle is a Class 1 misdemeanor.
| Policies effective | Bodily injury per person | Per accident | Property damage |
|---|---|---|---|
| 1 Jan 2022 to 31 Dec 2024 | $30,000 | $60,000 | $20,000 |
| On or after 1 Jan 2025 | $50,000 | $100,000 | $25,000 |
Section 46.2-108(D) makes it unlawful to rent a vehicle without a driver unless the vehicle is insured. This is a Class 1 misdemeanor, not a civil penalty, and it attaches to the act of renting an uninsured unit. Confirming coverage is active on every vehicle before it goes out is not just prudent, it is the difference between a compliance gap and a criminal charge.
The 50/100/25 figure is the state financial responsibility floor. Commercial rental fleet policies are typically written well above it, and airport concession agreements and corporate accounts frequently require more. Treat the statutory minimum as a floor, not a target.
A collision damage waiver notice in exact statutory wording, in boldface no smaller than 10-point, on the face of the agreement, with space for the renter to acknowledge receipt. Virginia also requires you to keep renter identity and rental time records open to inspection.
The Collision Damage Waiver Act sets out the exact text of the notice, which tells the renter that the waiver is optional, that their own insurance may already cover damage to the rental vehicle, and that purchase is not mandatory. You cannot paraphrase it. The formatting requirements are equally specific: on the face of the agreement, boldface, no smaller than 10-point type, with a space for the renter or driver to acknowledge receipt.
The Act was amended in 2020 to extend the notice requirement to peer-to-peer vehicle sharing platforms, not just traditional lessors. A host operating through a platform is inside this rule.
Virginia regulates how you disclose the waiver, not what you charge for it. That is the opposite of states that cap the daily rate. Price it commercially, disclose it exactly.
Section 46.2-108 requires records of the renter's identity and the exact time of the rental, and those records must be open to inspection not only by law enforcement but by any person injured in person or property by the vehicle's operation. Refusing inspection is unlawful. Build retrieval into your system rather than treating it as an exception.
10 percent on most passenger vehicles, made up of a 4 percent Rental Tax, a 4 percent Local Tax and a 2 percent Rental Fee. General sales tax does not apply on top, so 10 percent is the total transaction tax.
No. The 10 percent motor vehicle rental tax is the entire state and local transaction tax on a rental. This is different from states where a rental surcharge stacks on top of sales tax.
Yes. A Certificate of Registration as a rentor from the Department of Taxation, issued per place of business and not transferable. You need it before you can title a vehicle as rental stock.
Monthly, on Form MVR-420, due the 20th and delinquent on the 21st. Filing must be electronic. No return is required for a month with no rentals.
For policies effective on or after 1 January 2025, 50/100/25. Renting a vehicle without a driver when it is not insured is a Class 1 misdemeanor under section 46.2-108(D).
7 percent of gross proceeds if you register 10 or fewer shared vehicles across all platforms combined, instead of the 10 percent rental tax. Register more than 10 and the full 10 percent applies, even if fewer than 10 actually rent.
No. Virginia regulates the disclosure, not the price. The notice wording is prescribed exactly and must appear in boldface no smaller than 10-point on the face of the agreement.
12 months. At 12 months or more the transaction falls under lease and sale rules instead. That threshold is much longer than most states, which use 28 to 31 days.
