Compliance & Tax · New Jersey
New Jersey rental operators charge a $5 per day domestic security fee on the first 28 days of each agreement, capped at $140, plus 6.625 percent sales tax on the rental charge. The fee is not part of the base that sales tax applies to. Liability minimums rose to 35/70/25 for policies issued or renewed on or after 1 January 2026, which is the one thing every New Jersey operator must act on this year.

File Form NJ-REG with the Division of Revenue and Enterprise Services at least 15 days before you start trading. That produces a Business Registration Certificate and, where applicable, a Certificate of Authority permitting you to collect sales tax. There is no rental-specific operating licence.
NJ-REG must be filed at least 15 days before you engage in business activity. Operators who register the week they open are already late, and the Certificate of Authority is what legally permits sales tax collection.
The Business Registration Certificate and the Certificate of Authority must both be displayed at the place of business. This is checked.
Unlike Virginia, which requires a rentor certificate per location before you can title a vehicle as rental stock, New Jersey handles the domestic security fee as a tax account under NJ-REG rather than a separate licence. Fewer steps, but it also means there is no rental-specific registry confirming you are set up correctly.
$5.00 for each day or part of a day of a rental, charged on the first 28 days of an agreement with the same renter, with a hard maximum of $140 per agreement.
A four-hour rental carries the full $5. There is no proration, which matters if you run hourly or half-day products.
The cap applies to the first 28 days of an agreement with the same renter. Once you hit $140 on an agreement, the fee stops. A new agreement starts the count again.
If you rent a vehicle to another rental company, the fee still applies. Operators who move units between businesses during peak season routinely miss this.
Consideration for extras such as insurance products or excess mileage counts as part of the rental for fee purposes. The covered transaction is any agreement or invoice for the rental of a motor vehicle without a driver for use on public roadways. Commercial freight is outside it.
The DSF-100 form currently available on the state website is an old edition showing $2.00 per day and a $56 cap. Those figures have been obsolete since July 2006. The correct figures are $5.00 per day and $140. Use the fee amounts, not the ones printed on the form.
6.625 percent on the rental charge, collected by you and remitted to the Division of Taxation. The domestic security fee is not included in the amount sales tax is calculated on.
New Jersey has a single statewide rate of 6.625 percent, in force since 1 January 2018, with no county or city additions to track. That is a meaningful simplification compared with most states, where an operator has to manage dozens of local rates.
Sales tax is computed on the rental charge excluding the $5 per day fee. Getting this backwards overcharges the renter and creates a refund exposure. Build the two as separate lines in your system.
The fee caps at 28 days. The sales tax short-term rule uses six months. A rental of two months is past the fee cap but still short-term for sales tax, and the renter pays tax on each rental payment as the end user. Rentals longer than six months move to a different calculation method based on original purchase price or total lease payments.
Federal government rentals billed centrally are exempt from sales tax. The Urban Enterprise Zone exemption does not apply to motor vehicle transactions, so do not extend it to rentals.
Two separate returns on two separate schedules. The fee goes on Form DSF-100 quarterly, due the last day of the month after quarter end. Sales tax goes on Form ST-50 quarterly, due the 20th.
| Return | Covers | Due |
|---|---|---|
| DSF-100 | Domestic security fee | Last day of the month after quarter end |
| ST-50 | Sales tax | 20 April, 20 July, 20 October, 20 January |
| Monthly Voucher | Sales tax, high-volume only | 20th of the following month |
The fee is due at month end, sales tax on the 20th. Two reminders, not one. The 2026 fee deadlines fall on 2 February, 1 May, 31 July and 2 November, adjusted for weekends.
Form ST-50 must be filed every quarter including zero quarters, electronically through the state tax portal. The fee return does not carry the same requirement.
You move to monthly vouchers only if both conditions are met: more than $30,000 in New Jersey sales and use tax collected in the prior calendar year, and more than $500 collected in month one or two of the current quarter. Below either threshold you stay quarterly.
What was the ST-51 is now called the Monthly Voucher, and the ST-451 is the Quarterly Voucher. The old numbers appear in plenty of guidance and in older accounting software. The returns are the same.
35/70/25 for policies issued or renewed on or after 1 January 2026, up from 25/50/25. Every New Jersey fleet policy renewing in 2026 has to meet the higher floor.
| Policies issued or renewed | Bodily injury per person | Per accident | Property damage |
|---|---|---|---|
| Before 1 Jan 2023 | $15,000 | $30,000 | Not specified |
| 1 Jan 2023 to 31 Dec 2025 | $25,000 | $50,000 | $25,000 |
| On or after 1 Jan 2026 | $35,000 | $70,000 | $25,000 |
The increase took effect at the start of this year and applies on issue or renewal, not on a fixed date for all policies. A fleet policy renewing in, say, August 2026 picks up the new floor then. Insurers are required to notify the named insured when limits are raised to meet the minimum, but confirm rather than wait for the letter.
New Jersey's basic policy carries $5,000 property damage and makes bodily injury optional at $10,000 for all persons per accident, and the 2026 increase does not raise those figures. It is a personal lines product for drivers with few assets. A commercial rental fleet writes commercial auto, so 35/70/25 is the operative floor. Treating the basic policy numbers as compliant for a rental fleet would be a serious error.
For policies issued or renewed on or after 1 January 2023, uninsured and underinsured motorist property damage coverage carries a $25,000 aggregate limit per accident.
New Jersey has no peer-to-peer car sharing statute. Bills have been introduced repeatedly since 2022 and none has been enacted, which leaves hosts in a genuinely unsettled position.
A Peer-to-Peer Car Sharing Act was reported favourably out of committee as a substitute bill in September 2022 and went no further. It was reintroduced in March 2024 and again in companion form, and neither version advanced to enactment. As of October 2026 there is no chapter law.
Two things follow, and they cut in opposite directions. There is no special low rate for small hosts of the kind Virginia offers at 7 percent for 10 or fewer vehicles. There is also no statutory insurance framework assigning primary liability to the platform during a sharing period, which several states have put in place. A New Jersey host is operating without either the concession or the protection.
Whether a New Jersey peer-to-peer host owes the $5 per day domestic security fee is not settled by any published state guidance. The fee statute reaches rental of a motor vehicle without a driver, which on its face could include a shared vehicle, but no ruling or regulation confirms it. If you host in New Jersey, request a written determination from the Division of Taxation rather than relying on a platform's view or on what operators in other states do.
Cross into Virginia and the position is completely defined: 7 percent for 10 or fewer vehicles, platform collection above a nexus threshold, a five-year record retention rule and primary platform liability for third-party claims. New Jersey has none of that settled. For a host operating near a state line, that difference is worth understanding before deciding where to register vehicles.
A $5.00 per day domestic security fee on the first 28 days of an agreement, capped at $140, plus 6.625 percent sales tax on the rental charge. The fee is not included in the amount sales tax applies to.
Yes. The fee applies to each day or part of a day, with no proration. A short same-day rental carries the full $5.
Twice on different schedules. The domestic security fee is quarterly on Form DSF-100, due the last day of the month after quarter end. Sales tax is quarterly on Form ST-50, due the 20th, and must be filed even for a quarter with no sales.
35/70/25 for policies issued or renewed on or after 1 January 2026, increased from 25/50/25. The basic policy limits are lower but that is a personal lines product and not a compliant option for a commercial rental fleet.
No. Bills have been introduced since 2022 and none has been enacted. There is no special tax rate for small hosts and no statutory framework assigning primary liability to the platform during a sharing period.
Not settled. No published state guidance confirms whether the fee reaches peer-to-peer sharing. Request a written determination from the Division of Taxation rather than assuming either way.
The edition posted on the state website is from 2002 and predates the increase. The fee has been $5.00 per day with a $140 cap since July 2006. Use the current figures, not the ones printed on the form.
No rental-specific licence. File Form NJ-REG at least 15 days before trading to obtain a Business Registration Certificate and a Certificate of Authority, and display both at the place of business.
